TERMS AND CONDITIONS

§1. GENERAL TERMS.

The web gallery www.PhotosOn.net, further called the Gallery, belongs to Studio FOTOGRAM located at ul. Radockiego 158/11, 40-645 Katowice (Poland), taxpayer identification number (NIP): 954-180-83-62. The undermentioned document is a form of agreement between the Gallery and the Customer.

The main aim of the Gallery www.Photos.on.net is a mail order sale of printed (also framed) photographs, graphics or reproductions. Orders can be placed only by Customers who have read and accepted the terms and conditions.

The galleries, the blog and the systems enabling entering commentaries, which are available on the website of  the Gallery, are aimed to promote photography. Leaving insulting, defamatory or obscene comments as well as spamming is forbidden. Comments can be left only by net surfers who are familiar with and accept the terms and conditions.

4.

The Gallery is commited not to share any information about Clients with any other party. Such information will be used exclusively to process and account for orders, mail ordered items, and to provide our Customers with the information about essential changes in the offer. Accepting the terms and conditions Customers agree to receive information by E-mail.

5.

The Gallery and its licensors possess all rights and titles connected with the distribution of photographs / graphics. All the photographs / graphics are protected by copyright law and other legal regulations.

§2. ORDERS.

All prints sold by the Gallery are prepared to individual orders only (size, number, frame, etc.). Therefore, ordered and purchased items cannot returned.

Orders can be placed at:

- the online shop

- by e-mail.

3.

The listed prices are gross prices. The price of a product shown on the website of PhotosOn.net at the moment of placing an order is bounding for both sides. Shipment is not included in the price.

4.

The recipient is charged with p&p costs. The way of shipment is specified by the recipient in the order.

5.

Forms of payment:

- by transfer

- by credit card at www.dotpay.eu

- through PayPal system.

It usually takes 2 to 5 working days from the moment of receiving an order to send the ordered items. This depends on the kind of order, the quantity of items and possible framing. The Customer is always informed about the progress of his order by e-mail.

§3. COMPLAINTS.

The Customer is obliged to check the state of the received items and the conformity of the products with the placed order immediately on collection. Should any defects or shortage be found the recipient is obliged to draw up a written damage protocol in the presence of the person delivering products and , later, to contact the seller as soon as possible in order to account for the case at issue. If such a protocol is not drawn up and signed by the courier, the recipient`s claims referring to defects or shortage of the products delivered will not be considered.

In case of receiving defective, damaged or incomplete products we guarantee their replacement with quality products provided we are notified of the problem within 10 days from the day of delivery. Should the complaint be unjustified or the damage caused the user`s fault, all costs must be covered by the Customer.

3.

The complaint will be resolved within 5 days from the time of receipt of complained goods by the Gallery. The Customer will be informed about the complaint resolution by e-mail.

§4. LAW AND JURISDICTION.

Any dispute arising from, or related to, the present Contract will be subject to the jurisdiction of Polish courts.
